In the event of a breach of this clause, the Client agrees to pay liquidated damages in the amount of $85,000 USD. Both parties acknowledge that this is a reasonable estimate of the damages likely to result from such a breach, given the competitive nature of the services and the difficulty of quantifying the harm. This does not limit the Company’s right to seek additional actual damages or equitable relief.
To the maximum extent permitted by law, heyDominik LLC’s total liability for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid for the specific product or service giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages.
You agree to indemnify and hold harmless heyDominik LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, internet outages, platform changes by third parties (e.g. Instagram/Meta), government actions, or other force majeure events.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and heyDominik LLC regarding the use of our Services and supersede any prior agreements.
We reserve the right to suspend or terminate access without notice for breach of these Terms or abuse of the platform.
These Terms are governed by the laws of Wyoming, USA. All disputes will be resolved through binding arbitration in Sheridan, WY.
